AmCham Statement on the Customs Administrative Order Governing the Temporary Admission of International Cable-Laying and Repair Vessels (ICLRVs)

The American Chamber of Commerce of the Philippines (AmCham) welcomes the Bureau of Customs’ (BOC) Customs Administrative Order (CAO) establishing a clearer and more predictable framework for the temporary admission of International Cable-Laying and Repair Vessels (ICLRVs). This represents an important step toward reducing procedural uncertainty and improving the efficiency of customs processes for highly specialized vessels that support global connectivity and digital resilience.

We likewise support ongoing efforts to align customs procedures with the Customs Modernization and Tariff Act (CMTA) and international best practices, particularly in facilitating the timely installation, maintenance, and repair of submarine cables that are critical to the Philippines’ digital infrastructure, economic competitiveness, and connectivity security. A more efficient and predictable regulatory environment for these operations will also help strengthen the Philippines’ competitiveness and attractiveness as an investment destination by reinforcing the country’s reliability as a regional digital and connectivity hub and supporting continued investment in digital infrastructure.

As the BOC moves toward finalization and implementation of the measure, AmCham respectfully offers the following targeted refinements:

Provide a clearer and more standardized approach for security requirements.  While we recognize the importance of safeguarding government revenue, the current requirement of proof of posting of a security equivalent to 100% of duties, taxes, and other charges may create valuation uncertainty, inconsistent application, and avoidable operational delays. A more clearly defined, capped, or standardized methodology would help promote predictability and efficient implementation.

Extend the allowable short-term presence period for ICLRVs.  AmCham recommends extending the allowable “short-term presence” period to 30 days, with an option to extend for an additional 30 days. Cable repair and installation operations are often highly time-sensitive, weather-dependent, and operationally complex, requiring flexibility to ensure uninterrupted and timely completion of critical works.

AmCham believes these refinements would further strengthen clarity, consistency, and operational efficiency while preserving effective customs administration and regulatory oversight. We remain ready to support the government in advancing and implementing policies that enhance the Philippines’ position as a reliable, competitive, and investment-friendly digital connectivity hub.
